The Amendment of Hindu marriage act 1955 – India Law

As per the Supreme Court senior advocate Kamini Jaiswal it can currently take the couples anywhere from 6 months to 20 years to obtain a divorce. According to Union Law Minister M. Veerappa Moily there are 55,000 divorce cases pending in the courts across the country as reported in the local press.

Mr. Veerappa Moily also ruled out amending the Hindu Marriage Act in order to accommodate the Khap Panchayat’s demands. The Khap Panchayats have been demanding a ban on marriages within the same ”gotra” or sub caste and wanted the Hindu Marriage Act to be amended accordingly.

The amendment is based on the recommendations of the Law Commission, first in April, 1978 and then in March 2009, together with a series of judgments by the Supreme Court. In fact, the apex court had recommended to the Central government in 2006 that it should include irretrievable breakdown as a criterion for divorce between the parties’. Several cases have been decided by the courts where the marriage was completely broken and beyond reconciliation, but the courts applying the technicalities of the law subsisted the marital tie and could not give any relief to the parties’.

In the present circumstances, the judiciary has been adopting a more broadminded and realistic approach and several judgments of different courts confirm the fact that they no longer stick to the customary notion of indissolubility of the marriage knot.

Despite myths to the contrary, domestic newborn adoption remains alive and well in the United States. Current estimates of the annual number of infants adopted domestically (excluding foster and relative adoption) range from 25,000 to 30,000—more than all international adoptions combined. Moreover, the process can go much more swiftly that you might imagine. In a 2008 Adoptive Families survey, the majority of respondents were matched with a birthmother in less than 12 months, and 19% got “the call” to travel after the baby had already been born, without a prematch.

In most U.S. newborn adoptions, adoptive parents are selected by the birthparents of the child, and, in at least half of the cases, the birthparents and adoptive parents have met. Domestic adopters usually appreciate the opportunity to build a relationship with their child’s birth family. Ongoing contact is increasingly common, but the extent of contact varies significantly. A baby cannot legally be relinquished before birth. Most experts advise prospective adoptive parents to be careful about making an emotional commitment to a potential birthmother too early in her pregnancy.

Depending on the situation, and the laws of the state where the family lives and where the baby is born, prospective adoptive parents may cover some of the living and medical expenses of the birthmother.

Leaving Law

Thinking of a career change from law and finding it all a daunting prospect? Any number of factors can leave a lawyer feeling beholden to his / her profession, from money and security, to identity, kudos, or the expectations of others. There may even be an irrational sense of failure or admission of defeat in leaving law. In terms of a search for fulfilment however, staying on the treadmill can be a Sisyphean struggle for many.

It takes courage to leave a prescribed path, it is easier to stay on than get off, especially a pursuit in which you have invested so much time and effort already. The legal profession will always have a ‘shedding’. Like any occupation, it just is not for everyone, and there is no shame in admitting that. If you have done the job, you have a respected qualification and an education that will stay with you forever, and you will never suffer from a “what if” scenario of “I could have been a lawyer”. You have proved it to yourself.

There will always be a shedding because, inter alia: it is oversubscribed; because it does not suit all personalities (you might not be suited to Burlesque either); because people enter into it for fallacious reasons, such as parental influence, or a belief it offers something as a profession which it maybe did 20 years ago. Ultimately there can be a dawning that it just is not for you. It is very natural that in a field that can be as scrutinising as law, with its exacting demands, competitive element, billing targets, sometimes intellectual snobbery, this profession in particular induces the sort of soul searching that is a re-evaluation of your priorities and what makes you tick. After all, it is sometimes only when you are a bit older that you realise who you really are.

As described by Platinum Law Group, bankruptcy is a legally declared inability or impairment of ability of anual or organ individization to pay its creditors. Creditors may file a bankruptcy petition against a business or corporate debtor (“involuntary bankruptcy”) in an effort to recoup a portion of what they are owed or initiate a restructuring. However, in the majority of cases, bankruptcy is initiated by the debtor (a “voluntary bankruptcy” that is filed by the insolvent individual or organization). Platinum Law Group points out that an involuntary bankruptcy petition may not be filed against an individual consumer debtor who is not engaged in business.

Bankruptcy in the United States

Bankruptcy in the United States is a matter placed under Federal jurisdiction by the United States Constitution (in Article 1, Section 8, Clause 4), which generally allows Congress to enact “uniform laws on the subject of bankruptcies throughout the United States.” The Congress has enacted statute law governing bankruptcy, primarily in the form of the Bankruptcy Code, located at Title 11 of the United States Code. Platinum Law Group notes that federal law is amplified by state law in some places where Federal law fails to speak or expressly defers to state law.

While bankruptcy cases are always filed in United States Bankruptcy Court (an adjunct to the U.S. District Courts), bankruptcy cases, particularly with respect to the validity of claims and exemptions, are often dependent upon State law. Platinum Law Group finds that state law therefore plays a major role in many bankruptcy cases, and it is often not possible to generalize bankruptcy law across state lines.
